Acoustic Underlay Certification The Owner must provide an acoustic underlay certificate confirming that the proposed underlay achieves a minimum “5 Star Rating”. For the purposes of this renovation protocol, “5 Star Rating” means compliance with the performance standards published by the Association of Australian Acoustical Consultants (AAAC), or any successor or amended standard adopted by that body from time to time, including: Airborne sound insulation: not less than DnT,w + Ctr = 50; and Impact sound insulation: not greater than LnT,w = 45. The certificate must be issued by the manufacturer, supplier, or a suitably qualified acoustic consultant and must relate specifically to the materials proposed to be installed. 2. Flooring and Underlay Specifications Full details of the proposed flooring and underlay system, including product specifications, acoustic ratings, and installation methodology, must be submitted to the Owners Corporation for consideration prior to commencement of works. Compliance with Owners Corporation Rules and LawThe Owner must comply at all times with: The Owners Corporation Act 2006 (Vic);The Owners Corporations Regulations 2018 (Vic);The registered Rules of the Owners Corporation; and any reasonable directions of the Owners Corporation or its delegate relating to the works. 2. Approvals, Consents and PermitsThe Owner warrants that, prior to commencement of the works: All required approvals of the Owners Corporation under the Act or Rules have been obtained; and all necessary statutory approvals, including building permits and planning permits (where applicable), have been obtained and remain current. The Owner acknowledges that Owners Corporation consent does not replace or remove the need to obtain statutory approvals. 3. Standard of WorksAll renovation works must: Be carried out in a proper and workmanlike manner; Comply with all applicable laws, Australian Standards, and building codes; and be undertaken only by appropriately qualified, licensed, and insured contractors. 4. Contractors and ConductThe Owner must ensure that all contractors and tradespersons: Comply with the Owners Corporation Rules while on site; and observe that all common property, including garages and common areas, is a smoke‑free area unless otherwise authorised. 5. IndemnityTo the extent permitted by law, the Owner indemnifies the Owners Corporation against any liability, loss, claim, damage, cost or expense arising from or in connection with: The renovation works; or injury to persons or damage to common property or any other lot caused by or arising out of the works. 6. Damage to Common PropertyPursuant to section 24 of the Owners Corporations Act 2006 (Vic), if the renovation works cause damage to common property, the Owners Corporation may: Require the Owner to rectify the damage; or carry out the rectification and recover the cost from the Owner as due to the Owners Corporation. Any unpaid amount may accrue interest in accordance with the Act, Regulations, or Owners Corporation Rules.7. Hours of Work and AmenityTo minimise disruption to other occupiers: Noisy or disruptive works (including demolition) may only be carried out between 8:00 am and 4:00 pm, Monday to Friday;No works causing unreasonable noise or vibration are permitted on weekends or public holidays, unless prior written approval is granted by the Owners Corporation. 8. Protection of Common Property and Neighbour AmenityThe Owner must take all reasonable steps to: Prevent damage to common property; minimise inconvenience, noise, dust, and disturbance to other lot owners and occupiers; and ensure safe access and egress to all common areas at all times. 9. Waste Removal and CleanlinessThe Owner must ensure that: All renovation waste is removed from the site on a daily basis by the contractor; No renovation waste is placed in Owners Corporation bins or left on common property; and at the end of each workday, all areas accessed or used for the works are left clean, tidy, and safe. 10. Authority to ActWhere the applicant is not the registered proprietor of the Lot, the Owner must provide satisfactory documentary evidence of authority to act, such as a power of attorney; or Company, trust, or nominee authority documentation. 11. DocumentationAll required documentation, including approvals, permits, specifications, and contractor details, must be submitted with this application. Approval may be withheld or withdrawn if documentation is incomplete or inaccurate.
